Web Design Services Agreement
1. Scope of Work & Project Definition
Graphic Kandy provides professional website design, development, and related creative services (“Services”). The specific deliverables, project timeline, and launch requirements will be outlined in a separate, customized Project Proposal or Statement of Work (SOW) agreed upon with the Client. Any changes or additions to the scope after work begins may result in a revision of the project fee and timeline.
2. Project Timelines & Client Responsibilities
Validity of Estimates: Project proposals and pricing estimates are valid for 30 days from the date of issue.
Client Delays: Timely completion of the website relies heavily on the Client providing content, feedback, and image assets. If a project is delayed by the Client for more than 30 consecutive days without prior agreement, Graphic Kandy reserves the right to pause the project and bill for all work completed up to that date.
3. Client Revisions & Modifications
Our standard web design packages include a set number of revision rounds, which will be explicitly stated in your project proposal. Requesting design modifications or layout changes outside of these structured revision rounds, or after the final design approval has been signed off, will be treated as out-of-scope and billed at our standard hourly design rate.
4. Fees & Terms of Payment
Deposit: Unless otherwise specified in writing, a non-refundable deposit (commonly 50%) is required before any design or development work begins.
Final Payment: The remaining balance is due upon project completion, right before the website goes live or is transferred to the Client’s hosting account. Graphic Kandy reserves the right to withhold launch, file transfers, or final code delivery until full payment has cleared.
5. Intellectual Property & Code Ownership
GraphicKandy Material: All original templates, frameworks, unchosen design mockups, and backend code elements created by Graphic Kandy remain our intellectual property.
Client Ownership: Upon receipt of final payment in full, the exclusive ownership and copyright of the custom final visual design, website copy, and client-provided assets are transferred entirely to the Client.
Portfolio Display: Graphic Kandy retains the right to display screenshots, case studies, and links to the completed website in our design portfolio and marketing materials, unless a non-disclosure agreement (NDA) specifies otherwise.
